The legal proceedings against Lindsay Clancy, the Massachusetts nurse accused of strangling her three young children, took a dramatic turn after a state supreme court justice rejected an emergency appeal from her defense team, clearing the way for a potential retrial.
According to PJ Media, the justice ruled that Superior Court Judge William F. Sullivan was correct in declaring a mistrial after the jury failed to reach a verdict. With a mistrial in place, double jeopardy protections do not apply, meaning prosecutors can pursue a new trial against Clancy.
Deadlocked Jury Leads to Mistrial
The nine-woman, three-man jury reported being deadlocked on multiple occasions over several days, with one male juror reportedly the sole holdout. The jury sent three notes to the judge asking to be discharged, the last indicating an 11-to-1 split.
Defense attorney Kevin Reddington had pushed for the removal of the holdout juror, alleging misconduct and jury nullification. He argued that the juror was biased against individuals with debilitating mental illness, which he contended was a protected characteristic. Reddington wanted a clean verdict that would send Clancy to a mental health facility rather than prison.
Judge Sullivan disagreed with Reddington’s misconduct claims and moved to declare a mistrial. Just before the judge formally ended the trial, Reddington requested time to file an emergency appeal, which was granted.
Appeal Rejected
In his appeal to the Massachusetts Supreme Judicial Court, Reddington abandoned his original constitutional argument and instead claimed the judge refused to consider evidence that the juror was ignoring instructions and engaging in jury nullification. The high court’s justice sided with the trial judge, allowing the mistrial to stand.
Clancy faces potential charges of first-degree murder, second-degree murder, manslaughter, or a verdict of not guilty by reason of insanity. She has claimed that a combination of psychotropic drugs and postpartum depression led her to kill her children in their Duxbury home.
Public Support and Online Fundraising
Outside the courthouse, the case has drawn a passionate following. PJ Media reported that over 25,000 supporters have raised more than $835,000 for Clancy, a figure that has drawn criticism. The outlet described the scene as a “parallel trial” unfolding in public, with fans expressing solidarity, some even forming heart shapes with their hands.
The defense has already stipulated that Clancy committed the killings, but her supporters have suggested her husband was responsible, despite evidence indicating he was not at home at the time.
