Former President Joe Biden will not seek further legal review of a court ruling that cleared the way for the release of audio recordings of his conversations with ghostwriter Mark Zwonitzer, effectively ending his efforts to keep the materials private.
The decision follows a ruling earlier this week by a three-judge panel of the U.S. Court of Appeals for the D.C. Circuit that denied Biden’s emergency motion for an injunction. That motion had sought to block the Justice Department from releasing redacted transcripts and audio recordings of his private conversations with Zwonitzer.
The appeals court order in Heritage Foundation and Mike Howell v. United States Department of Justice was signed by Chief Judge Sri Srinivasan, an Obama appointee, and Judge Gregory Katsas, a Trump appointee. Judge Florence Pan, appointed by Biden, dissented and would have granted the injunction.
The Oversight Project, which brought the case, announced the development Friday, characterizing it as a complete victory in their transparency efforts. The organization stated that Biden’s decision not to pursue further review paves the way for the interview tapes to be released to the public.
Context of the Case
The legal battle centers on hours of recorded conversations between Biden and Zwonitzer related to Biden’s memoir. These recordings became a point of contention following Special Counsel Robert Hur’s investigation into Biden’s handling of classified documents.
In February 2024, Hur released a report finding that Biden “willfully retained” classified information but recommended against charging him. The report noted evidence that Biden retained classified notebooks while knowing he was not allowed to do so, and that he had shared material with Zwonitzer.
Despite the findings of willful retention, Biden was not charged with any crimes related to the handling of documents designated for Sensitive Compartmented Information Facilities, or materials shared with his ghostwriter.
Previous Transparency Wins
The Oversight Project pointed to this outcome as the latest in a series of successful efforts to obtain Biden-related materials. Last year, the organization secured the release of audio recordings from Biden’s interview with Special Counsel Hur.
The group has been vocal in its criticism of what it describes as Biden’s use of an “autopen” to avoid personal engagement with legal proceedings, framing the transparency fights as revealing broader concerns about executive accountability.
With Biden declining to seek further review at higher court levels, the recordings are expected to be released by the Justice Department in accordance with the appeals court ruling. The exact timing of the release has not been specified, though the legal obstacles to their disclosure have now been removed.
